These Terms are an agreement between you and REPYAJAWN LLC, a New York limited liability company ("we," "us"), which operates Heard ("the app"). By creating an account or using the app, you agree to these Terms and our Privacy Policy.
1. Who can use Heard
You must be at least 13 years old. If you are under 18, you must have permission from a parent or guardian.
2. Your account
You are responsible for activity on your account. Pick a username that doesn't impersonate anyone or infringe anyone's rights. You can delete your account anytime in Settings.
3. Your content
You own the reviews, comments, lists, notes, and other content you post. By posting public content, you give us a worldwide, non-exclusive, royalty-free license to host, display, and share it within the app so it can work as intended. This license ends when you delete the content or your account, except where others have already shared or interacted with it.
4. Zero tolerance for objectionable content and abusive users
Heard has no tolerance for objectionable content or abusive behavior. You agree not to post or do any of the following:
Harassment, bullying, threats, or hate speech
Sexually explicit, violent, or graphic content
Spam, scams, or misleading content
Impersonating another person or brand
Sharing someone's private information without permission
Anything illegal or that infringes someone else's rights
We filter certain language automatically. You can report any review, comment, or user, and block anyone. We review reports within 24 hours and may remove content and suspend or ban accounts that break these rules, without notice.
5. Podcasts and third-party content
Podcasts, artwork, and episode information belong to their creators and are provided through Apple's public podcast directory. Heard is not affiliated with or endorsed by any podcast or creator. Audio streams from each podcast's own servers.
6. Acceptable use
Don't misuse the app. That includes trying to hack it, scraping data, overloading it, or using it to send spam.
7. Ending your access
You can stop using Heard anytime. We may suspend or end your access if you violate these Terms or to protect other users.
8. Disclaimers
Heard is provided "as is" and "as available." We don't guarantee the app will always be available, error-free, or that content from other users is accurate.
9. Limitation of liability
To the fullest extent allowed by law, REPYAJAWN LLC is not liable for indirect, incidental, or consequential damages arising from your use of the app. Our total liability will not exceed $50 or the amount you paid us in the past 12 months, whichever is greater.
10. Apple App Store terms
If you downloaded Heard from the Apple App Store:
These Terms are between you and REPYAJAWN LLC only, not Apple. We, not Apple, are responsible for the app and its content.
Apple has no obligation to provide maintenance or support for the app.
If the app fails to conform to any warranty, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation.
We, not Apple, are responsible for any claims relating to the app, including product liability, legal compliance, and intellectual property claims.
You confirm you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
11. Changes
We may update these Terms. If we make significant changes, we will update the effective date and let you know in the app. Continuing to use Heard means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the State of New York, USA.
